Persons wishing to construct a building, or perform work or services in a Zoning District where some activities may be restricted may file a petition with the Board of Appeals.
All Zoning Districts have certain activities which may be performed under a qualifying “Conditional Use”. Other activities may be performed under “Special Home Occupation Permits”.
Buildings which may be too close to property lines can still be constructed via Board approval of a “variance”.
Other duties of the Zoning Board of Appeals include:
- Granting petitions for “Rezoning”
- Granting “Construction Permits” for Commercial Solar Energy Facilities, Commercial Wind Energy Conservation Systems and Tier 2 BESS facilities
- Hearings appeals of determinations made by the Zoning Enforcement Officer
- Preliminarily approving amendments and additions to the Zoning Ordinance.
The Zoning Board of Appeals consists of seven members, all residents of Fulton County, appointed by the County Board. Their terms are for five years each.
