b. Discussion/Action: Public Hearing To Request A Variance of Section10.A.1 Of The Fulton County Zoning Ordinance In Respect To Side Yard Minimums In The AC District.

Member Phillips asks for a representative to speak, none in attendance.
Roger Clark said he would call Mr. Hitchcock.
Members decided to proceed with next hearing and resume this matter at it’s conclusion.
*After the conclusion of the Vermont Fire District hearing, Roger Clark stated that Mr. Hitchcock was not yet in attendance. Discussion was had on how to proceed. It was decided to hear his case by phone with Roger Clark as representative.
Member Phillips asks Mr. Hitchcock to explain the variance request.
Mr. Hitchcock explains the proposed project.
Member Phillips confirms the need for a variance, swears Mr. Hitchcock in.
Member Myetich asks about a required petition for neighbors to sign.
Member Phillips discusses the requirements for the adjacent land owner’s notifications, but no required petition.

c. Discussion/Action: Public Hearing For A Conditional Use Permit To Construct & Operate A Fire Department On Parcel #20-22-29-122-001
Member Phillips swears in Joe Zanger, Morton Buildings
Mr. Zanger gives a quick introduction to the board and offers to provide any information requested of him.
Member Phillips clarifies the Conditional Use Permit to construct the Vermont Fire District Firehouse.
Mr. Zanger explains the handout/plans for the proposed building and site location.
Member Phillips explains the reasons why a CUP is needed per the Fulton County Ordinance
And inquires about setback distance and requirements.
Mr. Zanger responds with the measurements to the parcel lines.
Member Phillips determines no variance is needed, opens for public questions –none, opens for board member questions – none.
Member Phillips goes on to give report on his visit to the site. He expressed concern with electric and water lines run close to the property lines.
Mr. Zangfer explained that he is not in charge of the entire scope of work, but Brian Mercer, Vermont Fire Chief, had said the temporary power would be relocated.
Member Phillips asks for a motion to approve Vermont Fire District Conditional Use Permit.
