3. Call for Additions/Deletions to and Approval of the Agenda
Member McCullum moved to approve the agenda with a second from Member Sloan. Motion carried by voice vote with all voting ayes.
4. Approval of Previous Minutes – April 20, 2023 and May 2, 2023
Member Sloan moved to approve the minutes from April 20, 2023 and
May 2, 2023 with a second from Member McCullum. Motion carried by voice vote with all voting ayes.

7. Claims/Financial Report
Member Widger moved to approve the claims with a second from Member Sloan. Motion carried by voice vote with all voting ayes.
8. Zoning Office Report
Zoning Officer Emmons reported the Zoning Office received $4,036.10 in revenue during the month of May. Twenty new construction permits were received and 20 initial construction inspections were performed. There were13 final construction inspections performed, eight plat act affidavits have been signed and one subdivision plat approved. There were approximately 200 consultations conducted over the phone concerning zoning matters.
COMPLAINTS
Three complaints are under investigation. A modular home was installed near Vermont without a permit. A property owner built a rather large deck behind their home in Monterey without a permit.
A machine shed was constructed and renovated into a dwelling without a permit.
PUBLIC HEARINGS
The Fulton County Zoning Board of Appeals had a public hearing regarding a variance to the ordinance and setback for Scott Welker to construct a machine shed, within 30 feet of the state highway rather than 50 feet. The ZBA granted the variance to the front yard setback, and put a contingency liability on Mr. Welker to obtain permission from the State of Illinois prior to constructing the machine shed.
The Zoning Board of Appeals will have a June public hearing concerning the Dollar General in Avon. The request is to rezone the Dollar General property from AC to B and obtain a building permit. There have been a number of issues and problems with this matter and the Zoning Office is following State’s Attorney Jochums’ advice in addressing the matter.
9. New Business
a. Discussion/Action: DG Subdivision plat
Zoning Officer Emmons stated Matt Swanson has been working with Julie Russell Supervisor of Assessment and County Clerk O’Brian on this Subdivision and turned the discussion over the Julie Russell.
Supervisor of Assessment Russell discussed that the Village of Avon has been trying to annex the property the Dollar General has been constructed on. The steps were not completed at the county level prior to constructing the building. Russell stated when Dollar General came to get the building permit, they stated the property, used to construct the building was inside the Village of Avon city limits, thus Fulton County did not have jurisdiction. Russell stated the property has not been annexed from Fulton County and the county does have jurisdiction. This started the process to rectify the issues. The consensuses and first step from the States Attorney is the subdivision plat needs rectified. The Subdivision plat needs approved and Dollar General is in compliance with the Fulton County plat act. Russell agreed the plat needs signed.
Member McCullum moved to approve the Dollar General Subdivision plat with a second from Member Sloan. Motion carried by voice vote with all voting ayes.
b. Discussion/Action: Rezoning-DG subdivision
Zoning Officer Emmons stated the first step is the subdivision plat; step two is to appear in front of the Zoning Board of Appeals for the rezoning from Agi-conservation to Business. Once the ZBA approves
Member McCullum moved to approve the sending the rezoning for the Dollar General subdivision to the Zoning Board of Appeals with a second from Member Sloan. Motion carried by voice vote with all voting ayes.
10. Old Business
a. Discussion/Action: Resolution: Building Permit Fees Waived for
April 4, 2023 Disaster Victims of Fulton County
Julie Russell Supervisor of Assessment stated the Assessment Office had originally mailed out 110 applications for preferential assessment. Today, 147 parcels have been identified and 69 applications have been received in the assessment office. The notices of destruction need to be received by July 5, 2023, or 90 days after the storm, to receive the prorated assessment, so property owners don’t pay on a building that is no longer on the property. The PTAX327 form is the natural disaster homestead exemption, and this is for the people that lost their homes or their home was deemed uninhabitable. This allows property owners 2 years to construct a new home as long as the structure is located on the same parcel as the original structure. The square footage cannot be more than 110 square feet more than the original dwelling. The homeowner needs to apply for an exemption. The PTA327 tax exemption gives the homeowner the difference of the old dwelling and the new dwelling would receive a tax exemption, as long as the homeowner lives on the property. The homeowner needs to apply for the exemption every year. The goal is not to tax people out of their homes when they did not control what happened to them. Russell stated once the property is sold the property will be taxed at the new value of the homestead.
Member McCullum moved to approve the resolution with a second from Member Widger. Motion carried by voice vote with all voting ayes.
b. Discussion/Action: Resolution: Jed Rhoades petition to rezone parcel #09-08-28-100-014 from AC to B.
Zoning Officer Emmons stated the ZBA made the recommendation this property be rezoned from AC to B.
Member Kessel stated the resolution is to have on file for the rezoning of the property.
Member Sloan moved to approve the Resolution with a second from Member Widger. Motion carried by voice vote with all voting ayes.
c. Discussion/Action: 200th Anniversary Planning
Member Kessel stated the documents are in the process of being finalized and will be emailed and mailed. The contract for the band was been signed and returned to the band.
