a. Discussion/Action: Public Hearing To Request A Variance Of Section 11-A.1 Of The Fulton County Zoning Ordinance In Respect To Lot Width Minimums In The AC District. Parcel #10-09-15-300-004
Chairman Phillips asked if there was representative present. Mr. John McCarthy came forward to speak as representative of the estate of John S. Viano. He stated that Mr. and Mrs. Viano owned about 70 acres in Orion Township. They acquired the property on Jan 31st, 1955. The AC District provides for a minimum lot width of 150 feet. The purpose of this request is to obtain a variance in lot width from 150 feet to 128.6 feet. Surveys presented for the ZBA members to look over. He went on to explain that this property has existed in its present form for probably 100 years. There are farm fields on each side of the property. The plan is to sell 69 acres to a farmer and remaining 1 acre to an heir. Member Ackerman asked if there would be another house built on the lot. To which Mr. McCarthy replied no, there is already a house on the property. He clarified that they are dividing one acre out of the parcel. Chairman Phillips stated that the property was in this existence before Fulton County Zoning started.
Chairman Phillips asked if there were any members of the public who wished to speak on this matter.
There were none.
Chairman Phillips open for questions from the board members. Member Eathington clarified that the farm ground is being sold then asked about the plans for the remaining 1 acre. Mr. McCarthy replied it would be sold to an heir.
Chairman Phillips presented the finding of facts:
1. There are no objections to this request.
2. The condition of this land existed before Fulton County Zoning.

Chairman Phillips asked if there was someone who would like to speak on this matter. Mr. Greives identified himself and was sworn in. Chairman Phillips complimented the beautiful view while visiting the property. Mr. Greives agreed that there is a beautiful view of Rice Lake and the valley. They plan to run the short-term rental during the nice weather months, April through October or November. There is a six-acre lake, swimming pool, horseshoe pits, shooting range, and an archery range. It would be ideal for family gathering and things of that nature. People want to be able to come and enjoy Fulton County.
Chairman Phillips asked if there were members from the public who had questions on this matter.
There were none.
Chairman Phillips opened for questions from the board members. Member Roberson stated this makes sense. With agreement from other members. Member Eathington asked if the furniture would stay and if the kitchen would be available for guests to use. Mr. Grieves said yes, furniture would stay and the kitchen would be used. Member Myetich asked if hunting would be allowed. Mr. Grieves said no hunting would be allowed.
Charmain Phillips proposed the Finding of Facts
1. The site meets requirements for granting a Conditional Use Permit.
2. No objection from any neighbors.
3. This property use will be an asset to Fulton County.
